Navigating Appeal Proceedings before CAS – Practical Tips and Insights - CAS Code Commentary Series Note 1
CAS Code Commentary Series is a series of concise notes drafted by Dr Despina Mavromati, Attorney-at-law in Lausanne, UEFA Club Financial Control Body Member and CAS Arbitrator. The notes relate to issues often encountered in CAS proceedings and are based on insights developed in “The Code of the Court of Arbitration for Sport, Commentary, Cases and Materials”, by Despina Mavromati & Matthieu Reeb (Kluwer Law International, 2nd edition 2025, “CAS Code Commentary”). The notes provide only a few bibliographic and case-law references for ease of reference; for more detailed analysis, they point to the relevant parts of the CAS Code Commentary.
The first note of this series offers a general introduction to CAS appeal proceedings and navigates through some specific issues related to the CAS appeal proceedings, from the filing of the statement of appeal to the issuance of the final award and beyond. Specific issues such as CAS jurisdiction, the independence of arbitrators, provisional measures, evidentiary matters, and motions to the Swiss Federal Supreme Court (SFT) will be separately discussed in more detail as part of the CAS Code Commentary Series.
