When it comes to foreign nationals with criminal records who wish to enter or stay in the UK, the immigration laws can be stark and rather unforgiving. Sportspersons – footballers to swimmers and everyone in between, including entourage and support staff – are not immune.  The UK immigration system often appears to operate in a highly mechanistic and impersonal manner. Given the sheer number of applications received (literally hundreds of thousands each year[1]), the system seeks to standardise and formulaically consider applications from foreign nationals, usually against ever tougher requirements.

This article examines one of the immigration requirements that has been toughened and changed over the last few years: how the immigration authorities deal with applications from sportspersons with criminal convictions or pending prosecutions. It is a tricky topic, as the UK immigration system leaves little room for discretion or rehabilitation. Of course, it is to be expected that the UK immigration system will seek to exclude some people with criminal convictions. For sports players, coaches, and clubs, the issue lies in which offences prevent visa applications from being approved and whether there is discretion regarding past offences from many years ago.
