QC Mediation - Queen's Counsel launch expert mediation service
A panel of 25 Queen's Counsel has launched a mediation service as an alternative to increasingly lengthy and expensive litigation. Of particular interest to sports participants and lawyers will be some of the big names in sports law that the panel has attracted.
Dr. Nicholas Braslavsky QC, a personal injury and clinical negligence specialist, is a member of the Sports Resolutions Panel of arbitrators and mediators, as is Irish Senior Counsel Colm O hOisin for Just Sport Ireland.
The silks have some equally big names amongst their clients - Paul Chaisty QC acted for Wayne and Colleen Rooney in a matter of enforceability of agency contracts, and has appeared before both the Court of Arbitration for Sport and the FA/PL panel. William Norris QC, a former jockey, is the current Chair of the Anti-Doping panel.
The commercial courts are beginning to factor in alternative dispute resolution to the case management timetable, and adverse costs are a very real danger for those refusing to explore ADR, even if their claim is ultimately successful. In some cases the quick resolution that can be achieved through mediation may be very high on the agenda, such as in the case of a sportsperson prevented from active participation pending the outcome of their court case.
