The Court Of Arbitration For Sport (CAS) Opens Two Temporary Offices In Japan For The Tokyo 2020 Olympic Games

The Court of Arbitration for Sport (CAS) is preparing to open two temporary offices in Japan for the Tokyo 2020 Olympic Games (the Games). The first, the CAS Ad Hoc Division, will resolve any legal disputes that arise during the Games. This temporary tribunal has operated at every edition of the Summer and Winter Olympic Games since 1996, as well as at other major sporting events. The CAS Ad hoc Division will be able to render decisions within 24 hours in case of urgent matters.

The second temporary office is a section of the CAS Anti-Doping Division which will be in charge of anti-doping-related matters arising during the Games as a first-instance authority. This structure, in operation for the third time since its inauguration at the Rio 2016 Olympic Games, will handle potential doping cases referred to it by the International Testing Agency (ITA) in accordance with the International Olympic Committee (IOC) Anti-doping Rules.

Thanks to the kind cooperation of the Japan International Dispute Resolution Center (JIDRC), which has made its facilities available for the CAS operations in Tokyo, the CAS Ad hoc Division and the CAS ADD will be able to guarantee free access to high quality dispute resolution services conducted within a timeframe consistent with the competition schedule. However, due to the current sanitary measures in force in Tokyo during the period of the Games, CAS hearings will have to be conducted by video-conference.

The Division Presidents and arbitrators have been selected by the International Council of Arbitration for Sport (ICAS), an independent body, under the aegis of which the CAS operates. The Division Presidents and arbitrators selected to participate in these special CAS structures are all experienced lawyers, judges or professors specialized in sports law, anti-doping regulations and arbitration. In order to limit the presence of CAS representatives in Tokyo to the minimum necessary, some of the Division presidents and arbitrators will work remotely.

The offices will be headed by the CAS Director General, Mr Matthieu Reeb. Both CAS offices will operate from 13 July 2021 until 8 August 2021.
