1457/19 Justice, Fleisher v/ Grono Sportowa Spolka Akcyjna
The American Player, Kodi Andrew Justice, and his Agent, Eric Fleisher, filed a claim against the Polish Club, Grono Sportowa Spolka Akcyjna, for outstanding salaries, image rights payments, tax certificates, agent fees and interest. The Claimants submitted that the Respondent breached the Contract by failing to pay salaries and image rights payments from March to July as well as the agent fees. In its Answer, the Respondent did not contest the Claimants’ entitlement to the outstanding salaries and agent fees for the first season but argued that it did not owe any amounts for the second season because the acceleration clause should be construed as a penalty clause or alternatively that the Claimants did not suffer any actual losses. The claim was upheld.
