Decision of the Disciplinary Commission concerning the UCI WorldTeam Katusha

The Union Cycliste Internationale (UCI) announces that the President of the Disciplinary Commission has determined that: "The conditions for a suspension of Team Katusha in application of art. 7.12.1 the UCI Anti-Doping Rules have not been met."
Following the notification of a second case of an Adverse Analytical Finding (*) in the UCI WorldTeam Katusha within a twelve-month period, the UCI referred the matter to the Disciplinary Commission on 6 February.
The President of the Disciplinary Commission based this decision on the following considerations, among others:
- “The text of the article [7.12.1] refers to the fact that the decision must take into account "all the circumstances of the case";
- “With regard to the [Paolini case, it has been] established that the rider's taking of cocaine was not related to an intention to influence sporting performance but was rather taken on a "recreational" basis;
- “In this context, applying a suspension under article 7.12.1 when one of the two cases of Adverse Analytical Finding relates to [the use of] a social drug cannot be reconciled with the aim of the article. Even if, strictly speaking, such a case falls within the application of the anti-doping rules for the rider concerned, the imposition of negative consequences for the whole team would be inappropriate and disproportionate”;
- “It is understood that the intention of the article is to impose negative consequences on teams that lack control of doping for sporting purposes by their athletes, or if even worse scenarios exist, and/or if teams are not doing enough to fight such doping”;
- “The President of the Commission has expressed that he could share the view that it would be disproportionate to suspend a team on the basis that one of its members [uses] a social drug, the consumption of which is not related to sporting performance”.
(*): Summary of the two cases:
- On 10 July 2015, Luca Paolini, a rider from the UCI WorldTeam Katusha, was notified of an Adverse Analytical Finding (presence of cocaine) relating to a sample taken during an in-competition test on 7 July 2015. A disciplinary procedure before the UCI Anti-Doping Tribunal is under way.
- On 5 February 2016, Eduard Vorganov was notified of an Adverse Analytical Finding (presence of Meldonium) in a sample collected during an out-of-competition control on 14 January 2016. The rider is provisionally suspended until the adjudication of the affair.
Décision de la Commission Disciplinaire concernant l’UCI WorldTeam Katusha
L’Union Cycliste Internationale (UCI) annonce que le Président de la Commission Disciplinaire a déterminé que : « les conditions pour prononcer une suspension du Team Katusha en application de l’art. 7.12.1 du Règlement Antidopage de l’UCI ne sont pas réunies ».
Pour rappel, suite à la notification du deuxième cas de Résultat d’Analyse Anormal (*) au sein de l’UCI WorldTeam Katusha dans une période de douze mois, l’UCI avait saisi la Commission Disciplinaire en date du 6 février.
Le Président de la Commission Disciplinaire a fondé sa décision sur les considérations suivantes, entre autres :
- « Le texte de la disposition [7.12.1] fait ainsi référence au fait que la décision doit prendre en compte « toutes les circonstances de l’affaire » ;
- « S’agissant du [cas de Paolini, il est] établi que la prise de cocaïne par le coureur concerné n’avait pas de lien avec une intention d’influer sur la performance sportive mais relève d’une prise “récréative” ;
- « Dans ce cadre, prendre en compte comme l’un des deux cas de Résultat d’Analyse Anormal déclenchant l’application d’une suspension au regard de l’article 7.12.1, un cas d’usage d’une drogue sociale, ne correspondrait pas au but de la disposition. Même si formellement un tel cas relève de l’application des règles antidopage au niveau du coureur concerné lui-même, en tirer des conséquences au niveau de l’ensemble de l’équipe ne serait pas adéquat et serait disproportionné » ;
- « On comprend que la disposition vise à appliquer des conséquences à une équipe qui ne maîtriserait pas le dopage sportif en son sein, voir pire et/ou en tout cas ne ferait pas assez pour le combattre » ;
- « Le Président de la Commission peut partager l’avis qu’il serait disproportionné de suspendre une équipe du fait qu’un de ses membres consomme une drogue sociale et dont la prise n’est pas en lien avec ses performances sportives ».
(*) : Rappel des deux cas :
- Le 10 juillet 2015, le coureur de l’UCI WorldTeam Katusha Luca Paolini avait été notifié d’un Résultat d’Analyse Anormal (présence de cocaïne) dans un échantillon collecté à l’occasion d’un contrôle en compétition le 7 juillet 2015. Une procédure disciplinaire devant le Tribunal Antidopage de l’UCI est en cours.
- Le 5 février 2016, Eduard Vorganov avait été notifié d’un Résultat d’Analyse Anormal (présence de Meldonium) dans un échantillon collecté à l’occasion d’un contrôle hors compétition le 14 janvier 2016. Le coureur est suspendu provisoirement jusqu’à la résolution de l’affaire.
