The Cas Ad Hoc Division issues three decisions in the Bobsleigh/Skeleton cases
The Ad hoc Division of the Court of Arbitration for Sport (CAS) has issued three decisions concerning the allocation of quota places in bobsleigh/skeleton for the Olympic Winter Games Beijing 2022.
OG 22/03 Megan Henry (USA) v/ International Bobsleigh and Skeleton Federation (IBSF).Megan Henry requested that the IBSF apply the qualification system implemented in March 2020 and that a competitive slot in the Women’s Skeleton Event be awarded to her. She also requested that an interim stay of the IBSF decision allocating the last remaining quota place to the United States Virgin Islands be granted pending the outcome of the arbitration.
The Panel of arbitrators composed of Ms Annabelle Bennett, President, (Australia), Ms Maria A.Gwynn (Paraguay) and Mr Xianyue Bai (P.R. China), held a hearing on 30 January 2022 and dismissed the application considering that the United States Olympic & Paralympic Committee (USOPC) already had two athletes allocated, which filled the number of places allocated to this NOC. The Panel declined to reverse the decision of the IBSF Appeals Tribunal allocating the last remaining quota place to the US Virgin Islands NOC and, therefore, to the athlete Ms Katie Tannenbaum. As a consequence, the decision of the IBSF Appeals Tribunal on 25 January 2022 stands.
OG 22/04 Adam Edelman (ISR) and Bobsleigh & Skeleton Israel v/ IBSF. The Applicants requested the CAS Ad hoc Division 1) to grant and allocate two unused athletes quota spots to Bobsleigh Skeleton Israel for it to use in the 2-man Bobsleigh competition and 2) to allow Mr Edelman to make use of the two unused athletes quota places and to allow him to participate in 2-man Bobsleigh competition at the Olympic Games Beijing 2022.
A Panel of arbitrators composed of Mr Fabio Iudica, President, (Italy), Ms Maria A. Gwynn (Paraguay) and Mr Jingzhou Tao (France) held a hearing on 31 January 2022 and dismissed the application, with reasons to be published shortly.
OG 22/05 Irish Bobsleigh & Skeleton Association v/ IBSF and International Olympic Committee (IOC). The Applicant requested four additional quota places for the Men’s skeleton competition.
A Panel of arbitrators composed of Mr Jeffrey Benz, President, (USA), Mr Alain Zahlan de Cayetti (France) and Mr Xianyue Bai (China) held a hearing on 31 January 2022 and dismissed the application, with reasons to be published shortly.
