The CAS hearing in the arbitration procedure involving Caster Semenya, Athletics South Africa (ASA) and the International Association of Athletics Federations (IAAF) has concluded

The Court of Arbitration for Sport (CAS) hearing in the arbitration procedure between Caster Semenya, Athletics South Africa (ASA) and the International Association of Athletics Federations (IAAF) concluded today at 17:00.

In accordance with the timetable established in advance of the hearing, the Panel in charge of the matter closed the hearing and thanked the parties’ counsels for the quality and the comprehensive nature of their submissions. Over the course of the week, the Panel has had the opportunity to hear from all parties, experts and witnesses, with the IAAF President, Lord Coe, speaking at the outset of the hearing, and Ms Semenya having the last word today. The hearing was conducted in a cordial and respectful atmosphere throughout the entire week.

The Panel will now begin their deliberations in this case, that can be considered as one of the most pivotal CAS cases, and prepare their decision which is expected to be announced by the CAS Court Office on or before 26 March 2019.

The arbitration procedure concerns the application of the “IAAF Eligibility Regulations for Female Classification (Athletes with Differences of Sex Development)” that were due to come into effect on 1 November 2018 and which are currently suspended, pending the outcome of the CAS procedure. Although the CAS already had to examine a quite similar matter (the case of Ms. Dutee Chand v. IAAF) some months ago (but the procedure was terminated after the IAAF adopted the abovementioned regulations and abolished the previous rules), the present arbitration is conducted on the basis of fresh evidence.

L'audience du Tribunal Arbitral du Sport (TAS) dans la procédure d'arbitrage entre Caster Semenya, Athletics South Africa (ASA) et l'Association Internationale des Fédérations d'Athlétisme (IAAF) a pris fin aujourd’hui à 17h00.

Conformément au programme établi avant l'audience, la Formation arbitrale en charge de cette affaire a clos l'audience aujourd'hui et a remercié les conseils des parties pour la qualité et le caractère complet de leurs arguments. Au cours de la semaine, la Formation a eu l'occasion d'entendre toutes les parties, les experts et les témoins, y compris le Président de l’IAAF, Lord Coe, qui s’est exprimé à l’ouverture de l’audience, et Mme Semenya qui a eu le mot de la fin aujourd'hui. L’audience s’est déroulée dans une atmosphère sereine et respectueuse tout au long de la semaine.

Le Panel va maintenant commencer ses délibérations dans cette affaire, qui peut être considérée comme l’une des plus marquantes que le TAS ait connu, et préparer sa décision qui devrait être annoncée par le Greffe du TAS d’ici au 26 mars 2019 au plus tard.

Cet arbitrage concerne l’application des « Règles d'éligibilité pour la classification féminine (athlètes présentant des différences de développement sexuel) » de l'IAAF qui devaient entrer en vigueur le 1er novembre 2018 et qui sont actuellement en suspens en attendant le résultat de la procédure devant le TAS. Bien que le TAS ait déjà eu à examiner une affaire assez similaire (l’affaire Dutee Chand c. IAAF) il y a plusieurs mois (mais la procédure s’est terminée après que l’IAAF a adopté les règles mentionnées ci-dessus et aboli les règles précédentes), le présent arbitrage se déroule sur la base de nouveaux éléments de preuve.
