The Court of Arbitration for Sport (CAS) dismisses the appeal of David Nakhid

14 December 2015 – The Court of Arbitration for Sport (CAS) has issued its decision in the appeal filed by David Nakhid against the FIFA Ad hoc Electoral Committee’s decision of 28 October 2015 (the FIFA AEC Decision) in which his candidacy for the upcoming FIFA presidential election was refused. The CAS has dismissed the appeal and upheld the FIFA AEC Decision.
In its decision of 28 October 2015, the FIFA AEC found that Mr Nakhid had not presented declarations of support from at least five member associations, and for this reason, could not be admitted as a candidate for the election for the office of FIFA President on 26 February 2016.
In appealing to the CAS on 13 November 2015, Mr Nakhid sought the annulment of the challenged decision and an order that his candidacy be reinstated.
In line with the FIFA AEC, the CAS Panel found that one member association had issued declarations of support to two candidates, including one for Mr Nakhid, in violation of the applicable FIFA rules. As a consequence, those letters of support were disregarded, meaning that David Nakhid had not met the qualifying criterion of obtaining declarations of support from at least five member associations, and accordingly, his candidature could not be validated.
The full award with the grounds will be notified to the parties in a few days.
LE TRIBUNAL ARBITRAL DU SPORT (TAS) REJETTE L’APPEL DE DAVID NAKHID
14 décembre 2015 – Le Tribunal Arbitral du Sport (TAS) a rendu sa décision suite à l’appel déposé par David Nakhid contre la décision du Comité électoral ad hoc de la FIFA (CEA FIFA) du 28 octobre 2015 par laquelle sa candidature pour la prochaine élection présidentielle de la FIFA a été refusée. Le TAS a rejeté l’appel et a confirmé la décision du CEA FIFA.
Dans sa décision du 28 octobre 2015, le CEA FIFA a établi que M. Nakhid n’avait pas réussi à présenter des parrainages provenant d’au moins cinq associations membres et, pour ce motif, n’a pas pu l’admettre en qualité de candidat pour l’élection de Président de la FIFA du 26 février 2016.
Dans son appel au TAS du 13 novembre 2015, M. Nakhid a demandé l’annulation de la décision attaquée et le rétablissement de sa candidature.
Comme cela avait déjà été établi par le CEA FIFA, la Formation du TAS a constaté à son tour qu’une association membre avait émis des parrainages en faveur de deux candidats, parmi lesquels M. Nakhid, en violation des règles applicables de la FIFA. En conséquence, ces lettres de soutien n’ont pas pu être prises en considération, ce qui signifie que David Nakhid n’a pas rempli le critère consistant à obtenir le parrainage d’au moins cinq associations membres et donc que sa candidature n’a pas pu être validée.
La sentence motivée sera communiquée aux parties dans quelques jours.
