The Court of Arbitration for Sport (CAS) dismisses the appeals filed by the Bolivian Football Federation

The Court of Arbitration for Sport (CAS) has dismissed two appeals filed by the Bolivian Football Federation (BFF) against decisions issued by the FIFA Appeal Committee (FIFA AC) dated 12 January 2017. Accordingly, the FIFA AC decisions are confirmed and the matches played between Bolivia and Peru on 1 September 2016 (2-0) and between Chile and Bolivia on 6 September 2016 (0-0) are both declared to be forfeited and awarded 3-0 in favour of Peru and 3 - 0 in favour of Chile, with the resulting adjustment of FIFA 2018 World Cup qualification points.
One month after the matches in question, the Peruvian Football Federation and the Chilean Football Federation discovered that the Paraguayan-born player Nelson Cabrera might not have been eligible to play for Bolivia and informed FIFA accordingly. FIFA then initiated an investigation into the fielding of Nelson Cabrera by Bolivia in those two matches. In a decision dated 27 October 2016, the FIFA Disciplinary Chamber found that the BFF had breached the FIFA rules regarding nationality and, as a consequence, FIFA ordered that the matches between Bolivia and Peru and between Chile and Bolivia played in September 2016 be forfeited. On 12 January 2017 the FIFA AC confirmed such decision.
The case was referred to a CAS Panel composed of Prof. Massimo Coccia, President (Italy), Efraim Barak (Israel), and José Juan Pintó (Spain). A hearing was held in Lausanne, Switzerland on 5 July 2017. In the parties’ written submissions, and at the hearing, it was not disputed that Nelson Cabrera did not meet the eligibility criteria to play for the national team of Bolivia. Rather, the BFF questioned the validity of FIFA’s right to initiate an investigation into the matter and argued that there were inconsistencies between the FIFA Disciplinary Code (FDC) and the Russia 2018 World Cup Regulations, the latter regulations providing that official protests must be submitted within an hour of the match in question.
The Panel dismissed such arguments finding that FIFA had the right to initiate ex officio disciplinary proceedings against Bolivia under the FDC within a time limit of two years (Articles 108 and 42 FDC). Accordingly, the Panel dismissed the appeals and confirmed the challenged decisions.

EL TRIBUNAL ARBITRAL DEL DEPORTE (TAS) RECHAZA LAS APELACIONES PRESENTADAS POR LA FEDERACIÓN BOLIVIANA DE FÚTBOL
29 de agosto de 2017 – El Tribunal Arbitral del Deporte (TAS por sus siglas en francés) ha rechazado las dos apelaciones presentadas por la Federación Boliviana de Fútbol (FBF) contra las decisiones dictadas el 12 de enero de 2017 por la Comisión de Apelación de la FIFA (CA FIFA). En consecuencia, se confirman las decisiones de la CA FIFA y los partidos disputados por Bolivia contra Perú el 1 de septiembre de 2016 (2-0) y por Chile contra Bolivia el 6 de septiembre de 2016 (0-0) se consideran perdidos por Bolivia por el marcador de 3-0 en favor de Perú y 3-0 en favor de Chile, con su consecuente implementación en la tabla de las Clasificatorias Sudamericanas para la Copa del Mundo 2018.
Transcurrido un mes desde los partidos antes mencionados, la Federación Peruana de Fútbol y la Federación de Fútbol de Chile tuvieron conocimiento de que el jugador nacido en Paraguay, Nelson Cabrera, podría no cumplir con los requisitos de elegibilidad para jugar por Bolivia e informaron a la FIFA al respecto. La FIFA inició una investigación respecto a la alineación de Nelson Cabrera por Bolivia en dichos partidos. En virtud de la decisión de fecha 27 de octubre de 2016, la Comisión Disciplinaria de la FIFA determinó que la FBB incumplió con la normativa de la FIFA respecto a la nacionalidad y, como consecuencia de ello, la FIFA decidió que los partidos entre Bolivia y Perú y entre Chile y Bolivia disputados en septiembre de 2016 debían ser considerados perdidos por Bolivia. El 12 de enero de 2017, la CA FIFA confirmó esta decisión.
El caso se sometió a la Formación Arbitral del TAS compuesta por: Prof. Massimo Coccia, Presidente (Italia), D. Efraim Barak (Israel) y D. José Juan Pintó (España). La audiencia se celebró el 5 de julio de 2017 en Lausana, Suiza. Ni en los escritos presentados por las partes ni en la audiencia se objetó el hecho de que Nelson Cabrera no cumpliera con los requisitos de elegibilidad para jugar por la selección nacional de Bolivia. En cambio, la FBB cuestionó el derecho de la FIFA a iniciar una investigación respecto a la inelegibilidad del jugador y alegó ciertas inconsistencias entre el Código Disciplinario de la FIFA (CDF) y el Reglamento FIFA para la Copa del Mundo 2018, siendo este último el que establecía que una protesta oficial debía interponerse dentro de la hora posterior al partido en cuestión.
La Formación Arbitral rechazó estos argumentos estableciendo que la FIFA tenía el derecho de iniciar de oficio un procedimiento disciplinario contra Bolivia conforme al CDF dentro del plazo de dos años (Artículos 42 y 108 del CDF). En consecuencia, la Formación Arbitral rechazó las apelaciones y confirmó las decisiones apeladas.
