The Court Of Arbitration For Sport (CAS) Partially Upholds The Appeal Filed By Paris St-germain And Neymar Da Silva Santos Jr.

The Court of Arbitration for Sport (CAS) has rendered its final decision in the appeal filed by the French club Paris St-Germain and the player Neymar Da Silva Santos Jr. against the decision taken by the UEFA Appeals Body on 18 June 2019. The player was found to have insulted match officials through social media at the end of the Champions League match Paris St-Germain vs Manchester United on 6 March 2019 and sanctioned with a 3-match suspension from UEFA competition matches for which he would otherwise be eligible

Following an appeal filed on 18 July 2019 by both Paris St-Germain and the player, this CAS procedure was referred to a Sole Arbitrator, Prof. Ulrich Haas (Germany). A hearing was held at the CAS headquarters on 13 September 2019, during which the parties and their legal representatives were heard.

In application of Art. 15 (1) lit. b of the UEFA Disciplinary Regulations which provides for a minimum suspension of two matches in case of “abusive language” directed at a match official, the Sole Arbitrator partially upheld the appeal and reduced the suspension imposed by UEFA on Neymar Jr. to two (2) UEFA competition matches for which he would otherwise be eligible.

Le Tribunal Arbitral du Sport (TAS) a rendu sa décision finale suite à l'appel déposé par le club français Paris St-Germain et le joueur Neymar Da Silva Santos Jr. contre la décision prise par l'Instance d'appel de l'UEFA le 18 juin 2019. Le joueur avait été déclaré coupable d'avoir insulté des officiels de match par l’intermédiaire de réseaux sociaux à l’issue du match de Ligue des Champions Paris St-Germain – Manchester United le 6 mars 2019 et avait été sanctionné d’une suspension de 3 matchs à purger lors de compétitions UEFA.

Suite à un appel du Paris St-Germain et du joueur le 18 juillet 2019, cette procédure du TAS a été conduite par un arbitre unique, le professeur Ulrich Haas (Allemagne). Une audience a eu lieu au siège du TAS le 13 septembre 2019, au cours de laquelle les parties et leurs représentants ont été entendus.

En application de l'art. 15 (1) lit. b du règlement disciplinaire de l'UEFA, qui prévoit une suspension d'au moins 2 matches en cas de "langage abusif" dirigé contre un officiel de match (version anglaise du règlement), l'arbitre unique a partiellement confirmé l'appel et a réduit la suspension infligée par l'UEFA à Neymar Jr. à deux matchs de compétitions UEFA pour lesquels le joueur serait éligible.
