The Court of Arbitration for Sport (CAS) upholds the decision of the UEFA Congress to admit Kosovo as a member

24 January 2017 – The Court of Arbitration for Sport (CAS) has dismissed the appeal filed by the Football Association of Serbia (FAS) against the Union des Associations Européennes de Football (UEFA). FAS sought to annul a resolution passed at the UEFA Congress held in Budapest on 3 May 2016 in which the Football Federation of Kosovo (FFK) was admitted as the 55th member association of UEFA. As a consequence, the resolution remains in force and FFK’s admission as a member association of UEFA is confirmed.

In its appeal to the CAS, FAS argued that UEFA breached its own rules in admitting FFK as a member association and that such breaches meant that FFK’s membership contract should be declared null and void.

The CAS Panel in charge of this matter noted that FAS had both standing to sue in this matter and reasonable cause to file its appeal, considering that the relevant provision of the UEFA Statutes (Article 5 (1)) was ambiguous and required clarification. Such provision states that membership of UEFA is open to national football associations situated in the continent of Europe, based in a country which is recognised by the United Nations (UN) as an independent state. Considering that there is no formal recognition of countries by the UN, the CAS Panel interpreted Art. 5 (1) UEFA Statutes as meaning that the territory in which the football federation is located shall be recognised by the majority of the UN member states as an “independent state”. The CAS Panel found that this prerequisite was fulfilled with respect to FFK, and that such conclusion was also in line with the will expressed by the majority of the member federations at the UEFA Congress to accept FFK as a new UEFA member. As a consequence, FAS’ appeal was dismissed.

LE TRIBUNAL ARBITRAL DU SPORT (TAS) VALIDE LA DECISION DU CONGRES DE L’UEFA D’ADMETTRE LE KOSOVO EN TANT QUE MEMBRE

le 24 janvier 2017 – Le Tribunal Arbitral du Sport (TAS) a rejeté l’appel de l’Association de football de Serbie (FAS) contre l’Union des Associations Européennes de Football (UEFA). La FAS souhaitait obtenir l’annulation de la résolution adoptée lors du Congrès de l'UEFA qui s’est tenu à Budapest le 3 mai 2016, au cours duquel la Fédération de football du Kosovo (FFK) a été admise en tant que 55ème association membre de l'UEFA. En conséquence, la résolution reste en vigueur et l'admission de la FFK en tant qu'association membre de l'UEFA est confirmée.

Dans son appel au TAS, la FAS a fait valoir que l'UEFA avait violé ses propres règles en admettant la FFK en tant qu’association membre et qu’une telle violation devait entraîner l’annulation du contrat d'adhésion de la FFK.

La Formation du TAS en charge de cette procédure a noté que la FAS avait non seulement qualité pour agir mais également un motif raisonnable pour intenter un appel, étant donné que la règle pertinente des Statuts de l’UEFA (l’article 5 (1)) était ambigüe et nécessitait une clarification. Ladite règle prévoit que l’adhésion à l’UEFA est ouverte aux associations européennes, ayant leur siège dans un Etat indépendant reconnu par les Nations Unies (ONU). Considérant qu’il n’existe pas de reconnaissance formelle de pays par l’ONU, la Formation du TAS a interprété l’article 5 (1) des Statuts de l’UEFA comme signifiant que le territoire dans lequel la fédération de football se trouve doit être reconnu par la majorité des Etats membres de l’ONU en tant que « Etat indépendant ». La Formation arbitrale a constaté que cette condition préalable était remplie en ce qui concerne la FFK et que cette conclusion était également conforme à la volonté exprimée lors du Congrès de l'UEFA par la majorité des fédérations membres d'accepter la FFK en tant que nouveau membre de l'UEFA. En conséquence, l'appel de la FAS a été rejeté.
