UEFA Appeals Body’s decision on anti-doping rule violation
On 28 November 2019, following the 2019/20 UEFA Europa League group stage match (the “Match”) between Malmö FF and FC Dynamo Kyiv, Mr Artem Biesiedin (the “Player”) underwent an in-competition doping control test undertaken by UEFA. The analysis of the Player’s sample by a WADA-accredited laboratory revealed the presence of Fonturacetam which is a stimulant that is prohibited in-competition pursuant to S6 (a) of the 2019 WADA Prohibited List. Following an initial review, disciplinary proceedings were opened by UEFA against the Player on 7 January 2020.
On 31 January 2020, the chairman of the UEFA Control, Ethics & Disciplinary Body decided to refer these proceedings to the UEFA Appeals Body for a decision pursuant Article 29(3) of the UEFA Disciplinary Regulations.
The UEFA Appeals Body decided at its meeting on 24 February 2020, following a hearing, to suspend the FC Dynamo Kyiv player Mr. Artem Biesiedin for one (1) year, starting from the date in which the Control, Ethics and Disciplinary Body decided to provisionally suspend Mr. Artem Biesiedin (i.e. 19 December 2019) and ending on 19 December 2020, for committing an anti-doping rule violation.
No appeal was lodged against the UEFA Appeals Body decision of 24 February 2020 to the Court of Arbitration for Sport and therefore the decision is final.
