Valentino Rossi withdraws the appeal he filed at the Court of Arbitration for Sport

10 December 2015 – Valentino Rossi has withdrawn the appeal filed at the Court of Arbitration for Sport (CAS) against the FIM Stewards’ decision to impose 3 penalty points on his record following an incident with another rider during the Shell Malaysia Motorcycle Grand Prix race held on 25 October 2015.
In his appeal to the CAS, Mr Rossi sought the annulment of the penalty, or at least a reduction from 3 points to 1, since on the basis of the FIM Regulations, a rider with 4 penalty points must start the next race from last grid position. Together with his appeal, Mr Rossi filed an urgent application to stay the execution of the challenged decision in order not to lose his place on the starting grid at the final event of the season which was held in Valencia/Spain on 6-8 November 2015.
On 5 November 2015, the Sole Arbitrator appointed by mutual agreement of the parties, Prof. Ulrich Haas (Germany), dismissed Valentino Rossi’s request to stay the execution of the challenged decision. The Sole Arbitrator found that the conditions to grant the stay were not met, and accordingly, Valentino Rossi began the Valencia race from the last grid position.
Mr Rossi has now informed the CAS that he does not wish to continue with his appeal. Accordingly, the arbitration procedure has been terminated and the FIM decision will continue to remain in force.
VALENTINO ROSSI RETIRE SON APPEL SOUMIS AU TRIBUNAL ARBITRAL DU SPORT
Le 10 décembre 2015 – Valentino Rossi a retiré son appel soumis au Tribunal Arbitral du
Sport (TAS) à l’encontre de la décision des commissaires de la FIM d'imposer 3 points de pénalité dans le carnet de Valentino Rossi suite à un incident avec l’un de ses adversaires au cours du Grand Prix moto Shell de Malaisie le 25 octobre 2015.
Dans son appel au TAS, M. Rossi avait requis l’annulation de la pénalité, ou une réduction de celle-ci de 3 à 1 point, car selon les règlements de la FIM, un pilote avec 4 points de pénalité doit s’élancer depuis la dernière position de la grille de départ lors de la course suivante. Avec son appel, M. Rossi avait soumis une requête urgente de sursis à exécution de la décision appelée afin de ne pas perdre sa place sur la grille de départ lors du dernier Grand Prix de la saison, se déroulant à Valence/Espagne du 6 au 8 novembre 2015.
Le 5 novembre 2015, l’Arbitre unique nommé d’entente entre les parties, M. le Professeur Ulrich Haas (Allemagne), a rejeté la requête d’effet suspensif de Valentino Rossi. L’Arbitre unique a considéré que les conditions à remplir pour accorder l'effet suspensif n'étaient pas réunies et, en conséquence, Valentino Rossi a débuté la course de Valence à partir de la dernière position sur la grille de départ.
M. Rossi a informé le TAS qu’il ne souhaitait plus procéder avec son appel. En conséquence, la procédure arbitrale a été clôturée et la décision de la FIM continuera à déployer ses effets.
